In my original post, this site, I showed you how to send 1099's to
the old ASCAP board members and officers. The authority for that is
item 12 on the back of the member agreement, which states: The board
has final jurisdiction of the distribution of royalties. Hence, the
thieves are listed. The ASCAP website also lists all of the board
members and officers by name. The only address needed for the 1099's
is c/o ASCAP, One Lincoln Plaza, NY, NY 100--.
Now, here's the fun part: According to tax statutes, not only may
a BAD DEBT, or theft, be written off on tax returns, but ALSO ....
now get this, it's a beauty... the INTEREST on that bad debt may be
written off annually thereafter, and until the debt is paid (if
ever)AND.... at the highest rate allowed by law-that being 21%!!
It's also your choice whether to place your ASCAP royalties within a
business, trust, corporation, or leave them on your individual tax
return. It's all the Learned Hand rule (early US Supreme Court
Justice), who laid out the basic rule of tax law, to wit: A man may
set up his affairs any way that he wishes. There is no duty to set
up one's affairs so as to owe as much tax as possible.
So, in my case, ASCAP's president, Marilyn Bergman, received a
$120,000 1099 for the royalty thefts of 1994. Now, she can get a
$25,200 1099 each year thereafter as interest on the theft. Aint it
amazing what the actual return on a $300 recording investment is! Of
course, the IRS dares not overturn the Al Capone rule, which states
that stolen property is fully taxable to the thief; because this
would entail losing their number one weapon against organized crime
figures.
Now, for the biggest one of all. We can now go to a court that
ASCAP can't buy: the World Court. That entity now has a special
prosecutor assigned to prosecute any global entity which carries out
'social injustice'. I feel ASCAP more than qualifies on both points.
Best of all, the World Court can't be overrulled by anyone,
anywhere. Now, who's bored?

Your plan sounds just smart enough to get you a seat at your state
prison's Algonquin Round Table, stamping out license plates with all
the other rocket scientists.
After the IRS gets through with their audit of your return that
employs this tactic, let us all know how liquid your assets are.
Your ass will be wet enough, I'd venture.

Walter,
Just because YOU ARE TOO COWARDLY to take the law and
apply it on your own behalf doesn't mean everybody else is.
All you have to do to put Denny in jail is get a reversal of
Internal Revenue Service vs Al Capone, Et Al; Want to take
that one on, or are you too damnably idiotic to see that solution?

I'm not going to put Shaw in jail, and the IRS probably won't
either.
But they'll audit him and get the money they're rightfully owed
if he tries to deduct alleged thievery by ASCAP on his tax returns.
If they don't audit him immediately, it just means some
bureaucrat hasn't gotten around to it... yet.
